1. Scope
The following terms and conditions apply to all orders placed by customers through the online shop of AMAKA GmbH.
2. Contracting party, conclusion of contract
The contract of sale is concluded with AMAKA GmbH. The presentation of products in the online shop does not constitute a legally binding offer but an invitation to place an order. By clicking the order button you submit a binding order for the goods in the basket. Confirmation of receipt of your order is sent together with acceptance of the order immediately after submission by automated email.
3. B-stock, liquidation lots, used items
A substantial part of our range consists of B-stock, liquidation lots, leftover stock and used items. These are clearly marked as such on the product detail pages, with notes on their condition.
For used items and pursuant to § 476 (2) of the German Civil Code, the limitation period for claims for defects may be reduced to one year. For B-stock the condition-specific documented characteristics apply as agreed quality; obvious signs of use, storage or packaging damage do not constitute a defect insofar as they are stated in the product description.
4. Prices and delivery charges
All prices include the statutory VAT. In addition to the prices stated, delivery charges may apply; these are shown in the basket before the order is completed.
5. Delivery
The delivery time is generally [X] working days, unless otherwise stated in the product description. For warehouse goods from large lots a longer processing time may be required; this is indicated on the respective product page.
6. Payment

7. Retention of title
The goods remain the property of AMAKA GmbH until full payment.
8. Right to withdraw
Consumers have a right to withdraw in accordance with the statutory provisions. Details can be found in the separate withdrawal policy.
9. Dispute resolution
We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.
10. Applicable law, place of jurisdiction
German law applies to the exclusion of the UN Convention on Contracts for the International Sale of Goods. For consumers, this only applies insofar as no mandatory protective provisions of their country of habitual residence are excluded.
